Contractual Terms

Terms of Service

Effective Date: June 4, 2026. These Terms govern website usage, service requests, bookings, and repair agreements.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you (the "Customer," "User," or "you") and DTA Service LLC, doing business as DTA Appliance Repair ("we," "us," or "our"). By accessing our website (dta-service.com), requesting an appointment, or authorizing appliance diagnostic or repair services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Independent Service Provider Disclaimer

DTA Service LLC is an independent, private service provider. We offer repair and maintenance services for a wide variety of household and commercial appliance brands.

Affiliation Disclaimer: Unless explicitly stated otherwise in writing, we are not affiliated with, endorsed by, sponsored by, or officially authorized by any appliance manufacturer or brand (including, but not limited to, Sub-Zero, Wolf, Thermador, Miele, Viking, Bosch, GE, LG, Samsung, or Whirlpool). Any trademarks or brand names mentioned on our website are used solely for informational and descriptive purposes to indicate the types of appliances we service.

Licensing & Insurance: We maintain general liability insurance and comply with professional standards. Our technicians hold Environmental Protection Agency (EPA) Section 608 certifications required for the safe handling and service of refrigerants.

3. Booking, Diagnostic Fees & Estimates

Diagnostic Fee: A diagnostic fee of $76 is charged for our technician to travel to your location, inspect the appliance, and identify the failure. This diagnostic fee is fully credited toward the cost of the repair if you approve the recommended repair work during the same visit. If you decline the repair, the diagnostic fee is due immediately and is non-refundable.

Surcharges: Out-of-hours, Sunday, emergency, or specialty dispatches may be subject to a surcharge (e.g., +$40 for Sunday bookings), which will be disclosed to you at the time of booking. Surcharges are flat fees and are not credited toward repair costs unless agreed in writing.

Estimates & Approvals: Once the diagnostic inspection is complete, the technician will provide a written or verbal estimate detailing the repair scope, parts, labor, and total cost. No repair work will be performed without your explicit authorization. Estimates are valid for thirty (30) days from the date of the diagnostic visit.

Cancellations & No-Shows: To avoid cancellation fees, appointments must be cancelled or rescheduled at least twenty-four (24) hours before the scheduled arrival window. Failure to cancel within this timeframe or a customer's absence during the scheduled arrival window may result in a cancellation fee.

4. Repair Service & Parts Policies

Special-Order Parts: If a repair requires parts that are not stocked on our service vehicle, we will order them. Some rare or specialty parts may require 3 to 5 business days (or longer) for delivery. A deposit may be required before we order high-value or special-order parts. Once ordered, special-order parts are non-refundable.

Customer-Supplied Parts: To maintain safety standards and ensure warranty integrity, we do not install parts supplied by the customer. We only install certified OEM or high-grade aftermarket parts sourced through our verified distributors.

Access and Utilities: The customer must provide clear, safe access to the appliance, utilities (continuous water, gas, and electricity), and parking for our service vehicle. An adult (18 years or older) with authorization to sign paperwork and approve payments must be present for the duration of the service call.

5. Warranty Terms & Exclusions

60-Day Labor Warranty: We provide a 60-day warranty on labor for the specific repair performed, starting from the date of completion. If the same failure occurs within 60 days due to defective workmanship, we will return and resolve it at no labor charge to you.

Parts Warranty: Replacements parts installed by us are covered solely by the warranty terms provided by the manufacturer or distributor of those parts.

Warranty Exclusions: This warranty does not cover:

  • Pre-existing, unrelated failures or secondary issues not identified or repaired during the initial service call.
  • Damage caused by customer misuse, negligence, power surges, or environmental factors.
  • Appliances moved from the original service location.
  • Failures related to structural issues (e.g., clogged home dryer vents, plumbing blockages, gas supply issues, faulty electrical outlets).
  • Intermittent failures that were not present or could not be demonstrated to the technician during the diagnostic visit.

6. Limitations of Liability

To the maximum extent permitted by law, the liability of DTA Service LLC, its owners, employees, and subcontractors is subject to the following limitations:

  • Consequential Damages Excluded: We are not liable for any indirect, special, incidental, punitive, or consequential damages, including but not limited to food loss, laundry loss, business interruption, property damage, or alternative lodging/appliance rental costs.
  • Property Damage Exclusions: We are not responsible for pre-existing water damage, structural deterioration, gas or plumbing leaks, or electrical supply line failures. The customer is responsible for maintaining the structural safety of supply lines feeding the appliance.
  • Cosmetic Damage: We are not liable for minor cosmetic wear, scratches, or cosmetic damage to flooring, cabinetry, or walls resulting from the necessary removal, movement, or installation of appliances, particularly on aged or tight alcove units.
  • Maximum Financial Cap: In all circumstances, our maximum aggregate liability to you for any claim arising out of our services, website, or these Terms shall not exceed the total amount actually paid by you to DTA Service LLC for the specific service call out of which the claim arose.

7. Payment, Late Fees & Collections

Payment Terms: Payment is due in full immediately upon completion of the diagnostic visit or repair work. We accept cash, major credit cards (Visa, Mastercard, Discover, American Express), and digital wallets (Apple Pay, Google Pay).

Late Payments & Collections: Unpaid invoices may accumulate interest or late fees at a rate of 1.5% per month (or the maximum allowed by law, whichever is lower) starting thirty (30) days from the invoice date. The customer agrees to pay all costs of collections, including reasonable collection agency fees and attorney fees, in the event of non-payment.

8. Photo/Video Documentation

By booking our services, you grant permission for our technicians to take photos or videos of the appliance, surrounding workspace, and serial number plates. These files are used strictly for diagnostic records, warranty verification, safety compliance, insurance documentation, or technician training, and will not include any personal identifiers or photographs of individuals.

9. Website Content & DIY Disclaimer

All information, articles, blog posts, or repair tips published on our website are provided for general educational and informational purposes only. Do-it-yourself (DIY) appliance diagnostic or repair work can be hazardous due to electrical voltages, high-pressure gas, and moving parts. We disclaim any liability for injury, damage, or failure resulting from attempts to self-diagnose or repair appliances based on information found on this website.

10. Governing Law, Jurisdiction & Dispute Resolution

Governing Law: These Terms and any services provided by us shall be governed by, construed, and enforced in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.

Dispute Resolution & Venue: Any dispute, claim, or controversy arising out of or relating to our services, website, or these Terms shall be resolved in a court of competent jurisdiction located in Philadelphia County, Pennsylvania, or Bucks County, Pennsylvania. Both parties consent to the personal jurisdiction and venue of these courts and waive any right to a trial by jury or participation in a class action lawsuit.
